चावड़ी बाज़ार के कारोबारी की शिकायत पर जांच शुरू हुई कारोबारी का आरोप था कि उसके GST अकाउंट से किसी ने टैक्स रिटर्न फाइल किये हैं उनकी इस बात की जानकारी जब हुई जब उस कारोबारी के अपने GST अकाउनट का यूजर और पासवर्ड एक्सेस नही हो पा रहा था
जब कारोबारी ने GST ऑफिस में सम्पर्क किया तो कार्यालय ने उस कारोबारी को उसका यूजर और पासवर्ड दे दिया अकाउंट नंबर चेक करने पर पता चला कि उस अकाउंट नम्बर पर गलत खरीद और बिक्री चढ़ी हुई है
उसी अकाउंट में कारोबारी के ऊपर 21.64 लाख की GST की देनदारी है
इस शिकायत पर एसीपी वीर सिंह जामा मस्जिद थाना प्रभारी करण सिंह राणा और इंस्पेक्टर अरुण त्यागी  की टीम नें मामले की जांच चीटिंग मामलों के एक्पर्ट सब इंस्पेक्टर पवन कुमार यादव को सौंपी गई आईएसआई फतेह सिंह, सिपाही आनंद कुमार, सिपाही जोनी बाल्यान, सिपाही प्रह्लाद, सिपाही फखरुद्दीन और सिपाही रोशन भी इस मामले की तफ्तीश में लगाए गए


पवन कुमार यादव ने पता लगा लिया कि ITO स्थित कार्यालय में सुभाष नाम का कर्मचारी GST के कारोबारियों के यूजरनेम और पासवर्ड बताता था इसके बाद कारोबारियों के अकाउंट के यूजरनेम और पासवर्ड बदलकर फर्जीवाड़ा किया जाता था । पुलिस ने मुख्य आरोपी अंकुश अग्रवाल का पता ऑनलाइन टेक्निकल सर्वलान्स से लगाया था

इसकी गिरफ्तारी के बाद GST कार्यालय में काम करने वाले सुभाष चंद, अजय कुमार, हरीश, और कमल को भी गिरफ्तार कर लिया । इनमें सुभाष चंद, पहले GST कार्यालय से नोकरी छोड़ चुका था मगर यह अजय कुमार, हरीश, और कमल के सम्पर्क में था

 

 पुलिस द्वारा इस खुलासे के बाद  GST कार्यालय में हड़कम मच गया है GST कार्यालय के कर्मचारियों की मिली भगत के बाद सभी कारोबारी के मन में अपने अकाउंट को लेकर असुरक्षा बनी हुई है

With the arrest of five accused persons namely (1) Ankush Aggarwal aged 44 years r/o Acharya Kriplani Road, Near Jyoti Model School, Adarsh Nagar, Delhi; (2) Subhash Chand aged 42 years r/o Ward No.1, Mata Wali Gali, Dadri, Gautam Budh Nagar, UP; (3) Ajay Kumar aged 39 years r/o Gali No.6, Mangolpuri, Delhi; (4) Harish aged 24 years r/o Peer Wali Gali, Patparganj, Delhi and (5) Kamal aged 21 years r/o Vill. Nangal Thakran, Bawana, Delhi, the staff of Police Station Jama Masjid, Central District has busted an organized gang of fraudsters who were involved in filing of fake GST returns of different private firms and siphoned off Lakh of rupees.

 

BRIEF FACTS

Complainant r/o Chawri Bazar, Delhi gave a complaint at PS Jama Masjid stating therein that some unknown persons have unauthorized access to the GST Account of his firm. He further informed that some days before, while he visited GST office, one GST officer informed him that he has not filed any GST return in his GST account so far. Thereafter, he shared the username and password of his GST account to his niece for filing GST returns. Recently, he tried to access his GST account but he found that the username and password of the GST account have been fraudulently changed by some unknown/unauthorized persons. Thereafter, complainant visited the office of GST and managed to change the username and password of his GST Account by filing fresh request. On being checked the GST account details, he found that the fraudulent bills of transaction of sale and purchase were made in the GST account of complainant’s firm to which complainant has the liability of Rs. 21.64 lacs as GST tax. Complainant further told that he never made any transactions in the above mentioned GST account and all are fake transactions. Accordingly, a case vide FIR No. 48/19 u/s 420/120-B IPC was registered at PS Jama Masjid and investigation was taken up.

 

TEAM AND INVESTIGATION

Keeping in view the sensitivity of the matter and organized fraud with complainant, a team led by Inspr. Karan Singh SHO/Jama Masjid consisting of Inspr. Arun Tyagi Investigation/Jama Masjid, SI Pawan Yadav, ASI Fateh Singh, Ct. Anand Kumar, Ct. Johney Balyan, Ct. Prahlad, Ct. Fakruddin and Ct. Roshan was formed under the supervision of Sh. Veer Singh, ACP/Darya Ganj.

 

The team developed the information and deployed sources to have any clue about the culprits and the untiring efforts of team yielded results and the team finally zeroed in some persons who are involved in this racket and on 19.04.19, the team arrested one Ankush Aggarwal and recovered one laptop being used for uploading details of fake invoices of sale and purchase with the name of various private firms and two mobile phones which were used in the commission of crime.

 

INTERROGATION & MODUS OPERANDI

On sustained interrogation, accused Ankush Aggarwal disclosed that he used to collect details of defaulted firms from one Subhash, who was earlier working in the office of GST, (previously known as Sales Tax Office, ITO, Delhi) and used to meet him at GST office, ITO, Delhi. Subsequently, trap was laid to arrest other accused persons and another four accused Subhash, Ajay, Harish and Kamal were also apprehended by the team. The interrogation led to the recovery of three mobile phones being used for sending/ receiving messages.

 

The interrogation of accused persons revealed that Ankush Aggarwal provided the details of email Id, Password and mobile number to accused Subhash. Accused Subhash, with the help of accused Ajay, Harish and Kamal updated the details provided by the accused Ankush Aggarwal on the defaulted firms and send the information to accused Ankush. Further, accused Ankush uploaded the fake invoices of various private firms through the details of the firms provided by accused Subhash. In the present case, fake sale/purchase invoices of three firm’s were uploaded by using the GST Id of complainant’s firm. Till now, three chains of firms have been traced who are the beneficiaries by the act of accused persons, resulting in wrongful loss to complainant’s firm of about Rs. 21.64 lacs in the form of tax liability by uploading the fake invoices of total Rs. 1.21 crores.

 

Further investigation is under process and raids are being conducted to arrest the remaining accused but they are still at large.

PROFILE OF ACCUSED PERSONS

  1. Ankush Aggarwal is a graduate from Delhi University and started his own business of filing tax returns of various private firms. He claims to have very close terms with the officials of GST officials.
  2. Subhash Chand is running his own business of tent house in Gautam Budh Nagar, UP. He also informed that previously he was working as a Contractual employee in the office of GST office, ITO Delhi and have good relations with GST employees. He used to arrange the email ID’s, password & mobile numbers from accused Ankush Aggarwal and handed over the same to co-accused Ajay who in collision with his sources and associates arranged the defaulted firms and updated the email Id’s and mobile number provided by accused Subhash on the firms and sent back the information to Subhash.
  3. Ajay Kumar is working as private employee in the office of GST, ITO Delhi since last 7-8 years and used to supply the details of updated firms to accused Subhash.
  4. Harish is working as Data Entry Operator on contract basis in ward No. 79, 8th floor in the office of GST, ITO, Delhi. He is known to accused Kamal and Ajay. He used to arrange the updated firms with the help of co Accused Kamal.
  5. Kamal is also working as Data Entry Operator on contract basis in the office of GST, ITO, Delhi. Previously accused Kamal is working in the office of GST ward No. 10 & 11 in which the firm of complainant is attached. On the demand of other co-accused persons accused Kamal, updated the randomly selected defaulted firms with the email ID and mobile number provided by the co-accused persons.
